Monitoring Report No. 1: Implementation of the Law on Foreigners

NGO CASA has published its Monitoring Report No. 1 on the Implementation of the Law on Foreigners, providing the first systematic overview of how the law is being applied in practice since its full implementation began on March 15, 2026. The implementation of the Law on Foreigners will have a significant impact on the Serbian and other non-majority communities in Kosovo, particularly affecting individuals with unresolved civil status and those working or studying in key public sectors such as education and healthcare.

The goal of monitoring and highlighting problems is conducted in good faith to facilitate the exercise of individual rights, protect human rights and support the rule of law.

CASA’s monitoring reveals technical and legal gaps and challenges, resulting in legal uncertainty and barriers to accessing fundamental rights. The purpose is to provide insight into specific problems faced by citizens and to serve as a basis for further dialogue with institutions and improvement of existing procedures. At the same time, the report is intended to have a practical function – to contribute to the timely identification and removal of gaps and challenges throughout the implementation process—and to serve as a useful resource for all stakeholders involved.

An agreement between the European Union and the Government of Kosovo has introduced temporary measures to facilitate the transition, among them a three-month deadline for registering civil status in Kosovo. Serbian-issued ID cards are also recognized for initiating administrative procedures.

Monitoring is primarily focused on the group of affected persons who requests should be submitted by citizens themselves, where citizens have not been able to exercise their right to access documents through regular administrative procedures or have faced ambiguities and different interpretations in practice.

Note: This report represents the first step in an ongoing monitoring process, with additional reports to be published throughout the implementation period to track progress, highlight emerging challenges, and support continuous improvements.
